A “Reconciliation (Conciliation) Index” Proposed for Financial Disputes!

At the “2nd Savings and Waste Symposium” organized by Üsküdar University, Lecturer Durmuş Baysal, presenting the paper prepared by İskenderun Technical University, proposed an innovative approach based on the “Reconciliation (Conciliation) Index” for financial disputes.

During the presentation, attention was drawn to the concept of the “Reconciliation Index (Uzlaştırma / Helalleşme Endeksi),” which aims to be introduced into the literature, and it was stated that the understanding of reconciliation present in our ancient culture and civilization could be conceptualized as a measurable index in modern economic and legal literature.

It was emphasized that the mediation process is an institutionalized manifestation of reconciliation culture, and it was stated that the developed Reconciliation (Conciliation) Index would provide a technical and objective infrastructure for mediation practices.
 

In the presentation made at the symposium organized by Üsküdar University in memory of the late Prof. Dr. Ersin Nazif Gürdoğan with the theme “From Waste to Efficiency,” it was emphasized that financial disputes lead to significant resource waste not only at an individual but also at a societal level.

At the event, supported by important stakeholders such as Üsküdar University Faculty of Health Sciences, the Turkish Waste Prevention Foundation (TİSVA), Istanbul University Faculty of Economics, and İskenderun Technical University, and held at the NP Health Campus (Ümraniye) İbn-i Sina Auditorium, a presentation titled “The Conciliation Index in Resolving Financial Disputes: An Innovative Approach from Waste to Efficiency” was delivered.

Within the scope of the study titled “Conciliation Index in Resolving Financial Disputes,” conducted by İskenderun Technical University Rector Prof. Dr. Mehmet Duruel, Prof. Dr. Nazif Çalış, and Lecturer Durmuş Baysal from the Department of Economics and Finance, the following statements were made: 

Waste is not merely spending, but deviation from discipline…

It was stated that the concept of waste should not be regarded merely as excessive spending, but as exceeding the limits of legitimate, reasonable, and measured behavior, and deviating from disciplined resource utilization. In this context, it was emphasized that the inefficient use of physical and human resources in modern societies incurs significant costs that reduce social welfare.

It was stated that disputes between debtors and creditors generate not only direct costs such as litigation processes, enforcement expenses, and expert witness fees, but also indirect costs such as loss of reputation, disruption of commercial activities, and social tensions. It was noted that resolving such disputes quickly and fairly would contribute to directing public resources to more efficient areas.

The presentation also elaborated on the proposal to transform Anatolia’s ancient culture of reconciliation into a financial indicator, and it was stated that the created Reconciliation (Conciliation) Index would enable parties to evaluate the real change in monetary values over time more equitably.

The index must be based on a multi-faceted portfolio, not just inflation…

It was stated that the index should be based not only on the inflation indicator but on a multi-dimensional portfolio comprising indicators such as gold prices, real effective exchange rate, deflator, CPI, minimum wage, housing price index, and Brent Crude Oil price. It was emphasized that this approach offers a fairer and more equitable alternative in cases where late payment fees are insufficient.

From Anatolia’s ancient 'reconciliation' culture to conciliation…

Within the scope of the proposal to transform Anatolia’s ancient “reconciliation” culture into a financial indicator, the concept of the “Reconciliation Index (Helalleşme (Uzlaştırma) Endeksi),” aimed at being introduced into the literature, was detailed. In this context, it was emphasized that the consensus-based approach, expressed as the culture of reconciliation in our ancient culture and civilization, could be conceptualized as a Reconciliation (Conciliation) Index in today’s literature. It was stated that the creation of such an index would enable parties to evaluate the real change in monetary values subject to dispute over time in a fairer and more equitable manner.

Constitutional Court decision and the index…

The presentation also referred to legal developments, drawing attention to the Constitutional Court’s (AYM) decision dated July 8, 2025, and stating that the proposed index approach aligns with existing legal needs. In this context, it was recalled that the Constitutional Court determined that high inflation erodes the real value of receivables and ruled that the Grand National Assembly of Turkey must implement a legal regulation to protect the real value of receivables within six months. It was emphasized that the Conciliation Index approach, as an innovative solution alternative that both reflects economic reality and strengthens the perception of social justice, could make a significant contribution to these efforts.

Integrated Model with Mediation

It was stated that integrating the proposed model with the existing mediation system would increase efficiency, and it was emphasized that the mediation process is an institutionalized form of reconciliation culture. In this context, it was stated that the developed Conciliation Index would provide a technical and objective infrastructure for the mediation process. It was also stated that this transparent mechanism would strengthen the perception of justice and contribute to reducing social risks such as violence, domestic unrest, and loss of social trust.

Emphasizing that the consensus-based approach, referred to as the “reconciliation culture” in our ancient culture and civilization, meets on common ground with both the Reconciliation (Conciliation Index) and modern mediation practices in today’s literature, the evaluations concluded with the following statements:

“Mediation, as a process aiming for parties to reach a solution within the framework of mutual consent and good faith, can be considered an institutionalized and legally framed form of reconciliation culture. In this context, a developed Reconciliation (Conciliation) Index can provide a technical and objective infrastructure for the mediation process, enabling a more transparent and fair evaluation of the real change in monetary values subject to dispute over time. Thus, both the traditional understanding of reconciliation and modern mediation practices will be integrated within a measurable and comparable framework. Indeed, the institution of mediation stands out as an important mechanism that reduces waste and increases efficiency in the resolution of financial disputes, both economically and socially. The Conciliation Index approach serves to strengthen the culture of consensus at both economic and societal levels, while also building a direct bridge between the principle of efficiency and the traditional understanding of consensus. Finally, it was assessed that integrating the Conciliation (Reconciliation) Index with the existing mediation system would strengthen the perception of justice, increase social trust, and reduce economic and social waste arising from financial disputes.
