What is Intellectual Property Right?
Akköse, speaking about intellectual property rights, stated: “In a general sense, intellectual property rights are products that emerge as a result of creative thought and human ideas. If these products can be applied to industry, creating a technical effect in a technical field, they fall under industrial property rights. However, if they are merely works, meaning something that arises from people's emotions and thoughts, and thus qualify as a work, they are covered by copyright. Copyrights include works of science, literature, books, articles, musical works, etc.”
Copyrights and Their Importance
Akköse, addressing the topic of copyrights, stated: “Copyrights are rights granted over products created through an individual's intellectual labor. These works are protected under Law No. 5846 on Intellectual and Artistic Works. If you wish to protect your copyrights through registration, you can apply to the Ministry of Culture and Tourism and implement sanctions in cases where you believe infringement has occurred. As we all know, whether intellectual property rights, copyrights, or industrial property rights, they are negative rights, providing you with both a monopoly right against your competitors and allowing you to impose sanctions through material and moral compensation.”
You Can Protect Your Brand Forever
Akköse stated: “A brand, which is one of the industrial property rights, can be established as any sign that distinguishes a business's product or service from those of other businesses, containing novelty or distinctive content, such as sounds, words, shapes, letters, numbers, or the forms of original packaging. At the national level, we submit brand applications to the Turkish Patent and Trademark Office. The protection period is ten years from our application date. You can protect your brand forever by paying the annual renewal fees in ten-year periods.”
